These general terms and conditions (“GTC”), along with the Privacy Policy, govern the use of the online mediation platform Trippy Experience (platform “TE”), accessible at http://www.trippyexperience.com.

1. Who We Are

We, Trippy Experience S.R.L.S., located at Piazza Caduti in Guerra 28, Ceglie Messapica (BR), operate and are responsible for the TE platform. Our platform operates in Italy in two different languages and is quick and easy to use.

We manage the Trippy Experience platform as an intermediary platform where guided tours and tourist activities (collectively “Activities”) are offered online by a variety of local activity providers, such as amusement parks, museums, tour guides, or boat tours worldwide (“Providers”). Activities include guided tours, cooking classes, sightseeing bus tours, boat trips, tickets for sightseeing at monuments, and other services. In this activity, we act as commercial agents for the providers. Descriptions, photographs, and other content for their activities come from the individual providers. Therefore, we have no direct influence on such content.

2. Scope of Validity

2.1 These TE GTC apply to all visitors and users of the TE platform with all content within the offered operating systems (currently iOS, Android) (“Users”). From the moment the user uses the TE platform, they are obliged to comply with the TE GTC. Therefore, read them carefully before the first use.

2.2 They are available online and apply to all services unless more specific rules have been issued for a specific service. If this is the case, we clarify it at the relevant point. User conditions that conflict with or deviate from these TE are valid only if we have expressly agreed to them in writing.

2.3 The use of the TE platform is personal only for the user and therefore cannot be used for commercial purposes under any circumstances. Keyword: The resale of entry tickets is strictly prohibited! This means that any use that goes beyond the user’s personal use in their private environment and/or serves commercial or industrial purposes, to people personally associated with you and/or other third parties, particularly the commercial resale of entry tickets, is strictly prohibited.

3. What We Do

3.1 Our activities are visible on the TE platform. The contract for the provision of the activity is exclusively and directly concluded between the user and the provider (“private writing”). By purchasing an activity on the TE platform, the user buys directly from us. Performance agreements are concluded by us in the name and on behalf of the providers. We act as commercial representatives for the providers and are authorized by the providers to conclude deals directly between the providers and users, such as the user in question here, and on behalf of the providers and to collect payments from users. We do not offer any activities in person and therefore do not become a contractual partner in the service contracts. We do not act as organizers, landlords, sellers, or other contractual partners in relation to the service contract with the user. The mediation is given by a commercial agreement between us and the provider.

3.2 The user can filter the list of activities by different parameters. The search assistant shows the user the activities that match their criteria and offers from a specific provider. If more than one provider can offer an activity corresponding to the criteria entered in the discovery assistant, the respective activities are selected upstream and with a non-replicability criterion depending on the type of activity, the physical distances involved, and market demand.

3.3 In the interest of a quick and smooth booking, the user can ask the Trippy Experience customer service questions about their booking. Various assistance channels are available on Contact ⎸Trippy Experience. As commercial agents, we support the providers in carrying out. We usually respond as soon as possible. Communication between the user and the provider cannot take place directly.

3.4 We reserve the right to condition the use of the TE platform, individual functions of the TE platform, or the extent to which individual functions can be used on certain conditions, such as customer payment behavior (e.g., in the case of previously made bookings) or dependent on the presentation of certain evidence (e.g., proof of identity, purchase, payment, or ownership). We reserve the right to limit the booking of activities or to cancel activities booked by the user in the presence of suspected fraud, a violation against this TE, or against the obligations of the performance agreement made known to Trippy Experience.

3.5 We are not obligated to improve, expand (updates/upgrades), or make accessible the content, functions, and services provided through the TE platform. We can cease our services and performances at any time. There is no right to continuation.

4. Registration on TE

4.1 Registration is not necessary for access to the TE platform. However, to use all functions, such as the “wish list,” the user must register with us. 4.2 To set up a user area, the user must provide an authentic name and an email address in the registration form on the TE platform and can define a password. If available, the user can create an account without a password using the option to create an account without a password with a verification link via email. These data must be kept secret so that no one else has access to the user’s account. After clicking on “Confirm email,” the user receives a “welcome” email from Trippy Experience. Your user area is now active.

4.3 It is now possible to create only one TE account per user. It is not possible to transfer the account to another person.

5. Conclusion of the Contract with the User Agreement for Trippy Experience Users

5.1 The subject of the contract with us as a contractual partner is the free use of the TE platform (“User Agreement”). 5.2 The contractual relationship between us and the user is concluded as soon as the user uses the TE platform. Blocking, withdrawal, or deletion of the user profile is possible at any time.

7. Customer Service / Trippy Experience Best Price Guarantee

7.1 Our customer service is reachable on Contact|TrippyExperience. We are reachable by phone or email.

7.4 All special offers and discount promotions are marked as such.

8. Payment Methods in Trippy Experience

8.1 The activity applies to the price offered on the TE platform. The amount the user pays for an activity is the premium price minus any applicable discounts.

8.2 Trippy Experience has the right to receive the invoiced amounts in the name and on behalf of the provider (as a commercial agent), unless the provider’s invoice expressly states otherwise. With the payment made to TE, the user has fulfilled their payment obligations towards the providers with liberating effect.

8.3 The user must provide truthful payment information and update it immediately in case of changes. The allowed payment methods for the activity will be displayed during the order process. The general terms and conditions of the payment service provider apply. Towards us, the user has the obligation to confirm that they have the right or authority to use the payment method used.

8.4 By authorizing the payment, the user agrees that their payment information will be used to collect the payment on behalf of the provider. We reserve the right to make the use of the payment function or individual payment methods on the TE platform dependent on a necessary credit check.

9. Cancellations

9.1 The user can only cancel service contracts in accordance with the cancellation conditions stated in the SP by the provider, in the description of the activity on the TE platform, and on any voucher issued for the activity. 9.2 We can inform the user about changes and cancellations, especially if short-term, in the name of the provider at the phone number provided by the user and by sending changes to their email address, along with a full refund of the price of the canceled activity.

10. Reviews and Other User Content

10.1 We offer the user the possibility to leave reviews and other content on our Google My Business profile.

10.2 The user is obliged to ensure they have the necessary usage rights for the images before uploading user content. In particular, images or photos on which different people are visible can be uploaded to platforms other than TE only if the consent of these people is present. If the user wants to use images taken by another person, they will need the consent of that person.

10.3 Publicly accessible user content must not violate legal norms, morality, and/or third-party rights. In particular, the user may not upload and/or make publicly available any user content with representations of violence, pornographic content, discriminatory, abusive, racist, defamatory, or other illegal content or representations.

10.4 The user remains the owner of all content they create.

10.5 If necessary and at our discretion, we may remove user content. For example, Trippy Experience may remove user content if, in our opinion, it violates the obligations set out in paragraphs 10.2 and 10.3. We are not obligated to keep copies of user content or make such copies available.

10.6 Trippy Experience, its affiliated companies, and our (distribution) partners may display advertisements and other information next to or together with the user’s content on other media. The user has no right to any compensation for such advertisements. We reserve the right to modify the type and extent of such advertising measures. We will not inform the user about this.
